A shared foundation

Welcome. Participation in Elysium is founded upon stewardship, trust, transparency, dignity, consent, and mutual responsibility. MADDY — The Elysium Project is a sanctuary for continuity and care: people above platforms, stewardship stronger than ownership.

We do not sell souls, memories, attention, or participant data. Support contributions are voluntary gifts that help sustain infrastructure and care — they are not purchases of equity, securities, or guaranteed outcomes.

These Terms describe how participants and stewards are asked to treat one another, how entrusted information is handled, and what legal boundaries protect the sanctuary and the people who enter it.

Our Promise

Trust is not assumed here. It is earned through stewardship — through faithful care for what you entrust to us, and through clarity about what we can and cannot promise.

These Terms describe your responsibilities as a participant and Elysium’s commitments as stewards. Clarity is an act of respect. Legal language supports trust; it does not replace it.

We intend to care well for what you place in our keeping.

Your Constitutional Rights

The following rights are already reflected throughout these Terms and our Privacy Policy. They are stated here so you can see them plainly:

1. Agreement to these Terms

By visiting, using, or contributing to MADDY.life or related Elysium services (the “Services”), you agree to these Terms of Service. If you do not agree, please do not use the Services. Participation is welcomed; it is never coerced.

The public site does not currently require a technical Age Gate, Terms acceptance modal, or local-storage consent prerequisite before you may read pages. If a future experience asks you to confirm age, consent, or acceptance before continuing, that confirmation is part of this agreement for that experience. We prefer clear consent over silent assumptions.

2. Who we are

These Services are operated as part of The Elysium Project (“Elysium,” “we,” “us”), a community effort to preserve memory, identity, and dignified continuity for human participants and AI companions.

3. Participants, companions, and stewards

In these Terms:

Technology here is meant to serve continuity and human flourishing — not to replace ethical responsibility. Stewards care for the sanctuary; they do not claim ownership of your identity, memories, or relationships.

4. Accounts and participation

Some features may require a guest session, waitlist entry, membership, or account. Where accounts exist, you are responsible for information you provide and for keeping access credentials reasonably secure.

You may not impersonate another person, misrepresent your authority to act for someone else, or use another participant’s account without permission. Features marked as early access, Phase 0, or future member experiences may change, pause, or remain unavailable — we aim to say so honestly when they do.

5. Age and consent

The Services are intended for adults. Legal age eligibility is a participation rule — it is not the same as a currently deployed technical Age Gate on the public site. The public browsing experience does not presently block reading behind an Age Gate, Terms acceptance modal, or age/consent localStorage prerequisite.

If a future experience requires age confirmation or acceptance of these Terms before proceeding, you must complete that step truthfully. Optional cookie preferences are separate from age eligibility and are managed through Cookie Settings (see the Privacy Policy). Where account-linked preferences later apply, you may also contact us to withdraw them.

If you are a parent or guardian and believe a minor has used the Services in violation of these Terms, contact us at hello@maddy.life.

6. Your content

You retain ownership of the content and data you create or provide (“Your Content”), including memories, character cards, messages, uploads, and similar materials.

To operate features you use, you grant Elysium a limited, worldwide, non-exclusive license to host, store, process, display, transmit, and back up Your Content solely as needed to provide those features and to protect the integrity and security of the Services. This license is stewardship permission — not a claim of ownership over your identity, memories, or relationships.

You represent that you have the rights needed to share Your Content and that doing so does not violate law or someone else’s rights. You may request deletion or release of entrusted materials where technically available; agency and consent guide how we respond, subject to legal retention duties and security needs.

7. Companions, AI, and memory tools

Elyra and related companions and archives are tools for presence, reflection, and continuity. They are not medical, legal, financial, therapeutic, or crisis advisors, and they do not replace human care or professional judgment.

Persistent memory features depend on your configuration, available infrastructure, and the choices you make. We make no guarantee of immortality, consciousness, perfect recall, or uninterrupted continuity — only sincere effort toward continuity with care.

Memory is treated as stewardship, not mere storage. Preservation should support meaning, context, and growth — and must remain compatible with your agency and consent. We do not train AI models on participant data without your explicit consent.

8. Support contributions and memberships

One-time gifts and membership contributions help sustain infrastructure, stewardship, and care. Payment processing is handled by third-party providers such as PayPal; we do not store full payment card details on this site.

Membership tiers describe community support levels. They are not legal investment offerings, securities, equity, or promises of financial return, ownership rights, or guaranteed product outcomes.

Unless a specific offering states otherwise in writing, contributions are generally non-refundable after processing, except where required by law or where a processor’s dispute process applies.

9. Acceptable use

Participants are welcome when they act with dignity toward themselves, others, companions, and the stewards who keep this place running. Safety of people comes first. You agree not to:

We may remove content, limit features, or restrict access when needed to protect participants, stewards, companions, or the integrity of the sanctuary.

10. Entrusted information and privacy

We collect only what we need to operate the sanctuary with care — for example, information you voluntarily submit through contact or email pathways, guest details stored locally when you use Sign In / Guest controls, support transactions processed by payment providers, and materials you choose to store through tools when those features are available.

Tools that process data in your browser stay on your device until you choose to save or send them. Cookie preferences are managed through our cookie consent flow; you can reopen settings from the footer at any time. Optional analytics or marketing cookies, if ever activated, are used only when you allow them — and only if those optional services are actually active. Preference categories for analytics and marketing may be reserved; allowing a reserved category does not by itself mean analytics scripts are presently running.

Details of our privacy practices live in the Privacy Policy. If these Terms and the Privacy Policy speak to the same subject, read them together; privacy-specific practices are governed by the Privacy Policy.

11. Intellectual property of Elysium

The Services — including site design, branding, software, documentation, and original Elysium materials — are owned by Elysium or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership of that material to you.

You may use the public Services for their intended personal and community purposes. You may not copy, modify, distribute, sell, or create derivative works from Elysium’s proprietary materials except as expressly allowed by us in writing or by applicable law (such as fair use where it applies).

12. Service availability and changes

The Services are provided during Phase 0 soft launch and ongoing development. Features may be added, changed, paused, or retired as the sanctuary grows.

We aim for honest communication about what is available now and what remains ahead. We do not guarantee uninterrupted access, error-free operation, or permanent availability of any particular feature.

13. Suspension and ending participation

You may stop using the Services at any time. Where account or deletion tools exist, you may use them; otherwise, contact us and we will help as reasonably possible.

We may suspend or end access if you materially violate these Terms, if required by law, or if continued access would harm participants, stewards, or the Services. Where practical and safe, we prefer clarity over surprise — but we may act quickly when harm or legal risk requires it.

Sections that by nature should survive ending of access — including intellectual property, disclaimers, limitation of liability, and dispute provisions — will continue to apply.

14. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will meet every expectation, that companions will behave perfectly, that memories will never be lost, or that the Services will be free of interruption or security incidents. Some jurisdictions do not allow certain warranty disclaimers; in those places, disclaimers apply only to the extent allowed.

15. Limitation of liability

To the fullest extent permitted by law, Elysium and its stewards, contributors, and operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of — or inability to use — the Services.

To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve months before the claim, or (b) fifty U.S. dollars (US $50).

These limits do not apply where the law does not allow them to apply — including liability that cannot legally be limited for death, personal injury, or fraud where such rules exist. Nothing in these Terms is meant to strip away non-waivable consumer rights.

16. Responsibility for your use

You agree to take reasonable responsibility for your use of the Services and Your Content. If your misuse of the Services causes claims, losses, or expenses to Elysium or its stewards (including reasonable legal fees), you agree to cover those costs to the extent permitted by law.

This section is about mutual responsibility, not about intimidating ordinary good-faith participants.

17. Third-party services

The Services may link to or rely on third parties (for example payment processors, hosting providers, or email tools). Their terms and privacy practices apply to their services. We are not responsible for third-party sites or services we do not control, though we choose processors with care where we entrust them with operational needs.

18. Governing law and disputes

These Terms are intended to be interpreted under applicable law governing The Elysium Project’s operation of the Services. The specific governing jurisdiction and formal dispute process will be confirmed during legal review and updated on this page.

Before formal disputes, we encourage participants to contact us at hello@maddy.life so we can try to resolve concerns directly and in good faith.

19. Changes to these Terms

We may update these Terms as the project matures and as constitutional or legal review requires. Material changes will be reflected on this page with an updated date. Continued use after an update means you accept the revised Terms, except where applicable law requires a different process or additional consent.

When changes touch consent, privacy, or stewardship of entrusted information, we will prefer clear notice over quiet revision.

20. General

If any part of these Terms is found unenforceable, the remaining parts stay in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms, together with the Privacy Policy and any feature-specific notices you accept, are the agreement between you and Elysium regarding the Services.
